Privacy Policy
Last updated: Pending publication
This site exists to help people make a criminal record private. Handling their information carelessly would be self-defeating, so this policy describes what we actually do rather than reserving every right we could.
Draft pending attorney review. This policy has not yet been reviewed and approved for publication. It must not go live in its current form.
The short version
- The free eligibility screening runs entirely in your browser. Nothing you enter there is transmitted to us unless you create an account.
- Social Security numbers and driver's license numbers are encrypted before they are written to our database, using a key held separately from the data.
- We do not sell your information. We are a law firm service, not a data broker.
- You can request deletion of your account and documents at any time.
Information we collect
If you only use the eligibility screening: nothing. The screening tool computes your result in your own browser. Your answers are not sent to our servers and we never see them.
If you create an account, we collect what you give us:
- Identity: name, aliases, date of birth, race and sex (required by FDLE's form), and contact details.
- Government identifiers: Social Security number and driver's license number, where FDLE requires them.
- Criminal history: arrest dates, arresting agency, case numbers, charges, statutes, and dispositions.
- Documents you upload: certified dispositions, probation termination orders, identification, and similar records.
- Payment information, which is processed by Stripe. We never see or store your full card number.
We also collect ordinary technical information — IP address, browser type, pages visited — for security and to understand which parts of the site are useful.
How we protect it
- Social Security numbers and driver's license numbers are encrypted with AES-256-GCM before storage. A database copy alone does not reveal them.
- Uploaded documents are stored in private storage and are only reachable through short-lived links issued after an authorization check. There are no public document URLs.
- Every access to applicant data is written to an append-only audit log recording who, what, and when.
- Your Social Security number is never included in any request sent to an AI provider, and is stripped from application logs.
Artificial intelligence
We use AI to read uploaded documents and to answer your questions about your own matter. Three limits apply, and they are technical rather than aspirational:
- AI never decides eligibility. A model may extract facts from a disposition; those facts are then evaluated by fixed rules derived from the statutes. Eligibility determinations are reproducible and auditable.
- Identifiers are removed before any content is sent to an AI provider.
- Your information is not used to train any AI model.
Who we share it with
We disclose your information only where it is necessary to do the work:
- Government agencies you are applying to — FDLE, the clerk of court, the State Attorney, the court. That is the point of the service.
- Service providers who operate the platform: hosting, database, document storage, email delivery, payment processing, and our AI provider.
- Where the law requires it, such as a valid subpoena or court order.
We do not sell your personal information, and we do not share it for advertising.
How long we keep it
Matter records are retained in accordance with the file-retention obligations that apply to Florida attorneys, which generally require keeping client files for a period of years after a matter closes. Uploaded documents can be deleted on request once a matter is complete.
Records of what was done and when — the audit log — are retained longer, because their purpose is to be able to answer questions about access after the fact.
Your choices
- Request a copy of the information we hold about you.
- Correct anything inaccurate.
- Request deletion of your account and documents, subject to the retention obligations above.
- Withdraw from the service at any time.
Write to support@caseeraser.com to exercise any of these.
Children
Some Florida relief pathways concern juvenile records, and a minor’s parent or guardian may create an account on their behalf. We do not knowingly collect information directly from a child under 13 without parental involvement.
