These terms govern your use of CaseEraser. They describe what we do, what we do not do, and where the boundary between the two sits.
Draft pending attorney review. This policy has not yet been reviewed and approved for publication. It must not go live in its current form.
What we provide
CaseEraser offers three distinct things, and the difference matters:
- Eligibility screening. Free, automated, and based entirely on answers you supply. It is a screening tool, not a legal opinion and not a determination.
- Self-prepared document preparation. We generate completed forms from the information you provide. You review, sign, and file them. No attorney-client relationship is created.
- Attorney-reviewed service. A licensed Florida attorney at Sword & Shield, PLLC reviews your matter. This creates an attorney-client relationship, but only once you sign a written engagement agreement.
No attorney-client relationship without an engagement agreement
Using this website, creating an account, running the eligibility screening, or purchasing the self-prepared tier does not make us your lawyers. An attorney-client relationship arises only when you engage the attorney-reviewed service and a written engagement agreement is signed by both sides.
Until then, information you send us is not protected by the attorney-client privilege. Do not send us anything you would not want disclosed.
What we cannot promise
FDLE and the courts decide whether your record is cleared. We do not control either, and no one honestly can. Specifically:
- We do not guarantee that FDLE will issue a Certificate of Eligibility.
- We do not guarantee that a court will grant your petition. A judge may deny a petition even where you are statutorily eligible.
- We do not control how long any agency takes.
- Screening results reflect the answers you gave. If those answers are incomplete or wrong — which is common with old cases — the result will be wrong too.
Your responsibilities
- Give accurate and complete information. An omitted prior case is the most common cause of a denied application, and it is not something we can detect for you.
- Obtain the certified documents the process requires.
- Sign and notarize where required. We cannot notarize for you.
- Pay government fees directly to the agencies that charge them.
- Meet deadlines, including the 12-month expiry of a Certificate of Eligibility.
Fees and refunds
Our fees are shown before you pay and are separate from government fees. Government fees — including the $75 FDLE processing fee — are paid by you directly to the agency and are non-refundable by that agency regardless of outcome.
If we have not begun preparing your documents, our service fee is refundable. Once preparation has begun, refunds are handled case by case. On the attorney-reviewed tier, if FDLE rejects a packet because of an error we made, we correct and resubmit it without an additional service fee.
Firm subscriptions bill monthly and may be cancelled at any time, effective at the end of the current billing period.
Acceptable use
- Use the service only for your own record, or for a client or family member you are authorized to act for.
- Do not submit false information to us or to any government agency. Making a false statement on a notarized FDLE application is a crime.
- Do not attempt to access another user's matter, or to circumvent access controls.
- Do not scrape, resell, or redistribute our content or documents.
Limitation of liability
To the extent permitted by law, our total liability arising out of the self-prepared service is limited to the fees you paid us for the matter in question. Nothing in these terms limits liability that cannot lawfully be limited, including an attorney’s professional obligations to a client on the attorney-reviewed tier.
Governing law
These terms are governed by the law of the State of Florida, without regard to its conflict-of-laws rules. Venue for any dispute lies in Leon County, Florida.
Changes
We may update these terms. Material changes will be notified to account holders by email, and the date at the top of this page will change.
