If the State Attorney agrees you acted in lawful self-defense and your charges were dropped or never filed, Florida gives you a separate expungement route. It is the most overlooked relief in the statute — and it does not use up your one-in-a-lifetime sealing or expungement.

Eligibility also depends on your record as a whole — a prior adjudication of guilt in any case, in any county, can close this route even when the case you want cleared looks clean.
Does self-defense expungement require a court hearing?
Yes. After FDLE issues your Certificate of Eligibility, you file a petition, a sworn affidavit, and a proposed order with the court in the county where you were arrested. A judge must sign the order before the record is actually cleared.
Does self-defense expungement use up my one-in-a-lifetime relief?
No. This is one of the Florida pathways that does NOT consume your single court-ordered sealing or expungement. If you qualify here, you keep that allowance available for a different record later — which is a significant advantage most people do not know about.
What does self-defense expungement cost?
FDLE charges a non-refundable $75 processing fee, paid by money order or check. You will also pay the clerk of court for certified dispositions, and possibly a fingerprinting fee. Our preparation fee is separate and disclosed up front.
